M·A·C PRO Privacy Policy

M·A·C PRO is committed to protecting your privacy. We have a general policy of openness about how we collect, use and disclose your personal information. This privacy policy explains how M·A·C PRO collects, uses, shares and protects personally identifiable information ("PII") collected in Canada and the United States (hereinafter "Privacy Policy (NA)"). When you provide us with your PII, you consent and agree to our use and disclosure of your PII in accordance with this Privacy Policy (NA). In this Privacy Policy (NA) we also explain what you may do if you have a question or want to make a change to or delete any PII that M·A·C PRO may be holding about you. We strongly recommend that you take the time to read t his Privacy Policy (NA) and retain it for future reference.
Please note that this Privacy Policy (NA) does not address and does not govern PII collected by freestanding M·A·C stores ("M·A·C Stores") (other than a M·A·C PRO application that you may submit at a M·A·C Store), at cash registers at M·A·C counters at retail stores such as Macy's, Nordstrom etc. ("M·A·C Counters") or on M·A·C websites other than www.macpro.com ("M·A·C PRO Site"), e.g., www.maccosmetics.com, www.macaidsfund.org (collectively, M·A·C Sites"). The M·A·C PRO Site may contain links to or from other websites. Please be aware that we are not responsible for the privacy practices of other websites, including, without limitation M·A·C Sites. We encourage you to read the privacy policies of other websites you link to from the M·A·C PRO Site or otherwise visit.
This Privacy Policy was last updated and is effective as of March 9, 2006.
I. What PII does M·A·C PRO collect about you and how does it collect it?
We do not collect PII about you, except when you provide it to us voluntarily or it is available to us through the press or a business or trade association or relationship. In addition to the personally identifiable information we collect during the application process (described in Section I(A)), if you decide to place an order on the M·A·C PRO Site, you will need to provide your delivery and billing address, credit card number and expiration date in order for M·A·C PRO to process your order. If you would prefer that we not collect any personally identifiable information from you, please do not provide us with any such information.
A. Application Process
In order to participate in and enjoy the benefits of M·A·C PRO, you will need to provide your name, home and/or business address and phone number(s). We collect your email address if you elect to provide it. In addition, as part of the M·A·C PRO application process, you will be asked to provide information designed to verify your entitlement as a "professional" to participate in this unique program.
B. M·A·C PRO Online
1. Information You Provide
As a M·A·C PRO member, you will be issued a M·A·C PRO Membership number that you may use to access the M·A·C PRO Site. We do not collect personally identifiable information about you, except when you provide it to us. For your security and protection, when you visit the M·A·C PRO Site, you will be asked to provide your M·A·C PRO Membership number and certain additional information such as your contact information, e.g.last name, email address, mailing address, and telephone number, for verification purposes. To protect your personal information, users registering at the Site must also create a password. If you decide to place an order or renew your membership online, you will also need to provide credit card information such as credit card number and expiration date as well as delivery and billing address. We will store this credit card information for future renew als if you elect to sign up for automatic renewal of your M·A·C PRO membership.
The M·A·C PRO program and this M·A·C PRO Site are designed for professionals and are not intended for children. M·A·C PRO does not knowingly collect personally identifiable information from any children under 13.
2. Pixel Tags, Cookies and IP Addresses
When you visit the M·A·C PRO Site or view one of our e-mails, we may use pixel tags (also called "clear" gifs), tracking links and/or similar technology to track some of the pages you visit on our M·A·C PRO Site and personalize your experience. We may also use pixel tags to determine what types of email your browser supports. We may use the information collected through pixel tags, tracking links and similar technology.
A cookie is a piece of data that enables us to track and target your preferences.We may place a "cookie" on your computer's hard drive so we can recognize you as a return user and personalize your experience and your use of the M·A·C Pro Site. The cookie will be stored on your computer's hard drive until you remove it. We may also use temporary or "session" cookies when you make a purchase online. These cookies will expire when you place an order. You can have your browser notify you of, or automatically reject, cookies. If you reject our cookies, you may still use our M·A·C PRO Site, but you may be limited in the use of some of the features. We may also use IP addresses to analyze trends, administer the Site, track traffic patterns, and gather demographic information for aggregate use, as well as in combination with your personally identifiable information for credit fraud protection and risk reduction.
We are continuously working to make your experience on the M·A·C PRO Site better. To this end, we have retained a company, Coremetrics, to assist us in better understanding your use of the M·A·C PRO Site. Coremetrics will place cookies on your computer to collect information on our behalf that will show us how you come to our M·A·C PRO Site and how you use and navigate the M·A·C PRO Site. Coremetrics is contractually required to maintain all information collected on our be half in confidence. However, you may elect to limit or eliminate the data that Coremetrics collects regarding your use of the M·A·C PRO Site by

Some of our other business partners and service providers may also use cookies on the Site. However, we have no access to, or control over, these cookies and do not accept any responsibility for such use. Only Coremetrics cookies may be accepted or declined as described in the preceding paragraph.
3. Security
We implement various security measures in accordance with industry standards to protect the security of your personal information both online and offline. Your personal information may be stored at facilities located both inside and outside the United States and the European Union. II. How and where is my PII stored?
We use reasonable measures designed to assure the security of your PII. When you provide us with your PII, we may enter your information into databases. Once your information is in a database, it will not be used for any purpose not set forth in this Privacy Policy (NA). The M·A·C Companies and third parties referenced in Sections IV who will receive your information only for the purposes set forth in this Privacy Policy and the databases in which your PII may be stored may be located in the United States, Canada and throughout the world in countries which may not offer the same level of protection of PII as the country in which it was provided. Nevertheless, we respect your privacy and your PII shall only be collected and used in the manner set forth in this Privacy Policy (NA). By providing PII to M·A·C PRO, you acknowledge and accept that the M·A·C Company, third party or database which receives your PII may be located in the United States, Canada or within a state or country which does not guarantee the samelevel of protection for personally identifiable information as the one in which you reside.
III. For what purposes is my PII used by M·A·C PRO?
At M·A·C PRO, we are committed to building good will and allegiance among M·A·C's most important customers. To this end, M·A·C PRO offers its members a host of benefits including M·A·C product discounts, seasonal trend reports, master classes, preview nights and special events. In order to provide you with quality membership service, we may use your PII for the purposes described below:
A. Customer Service
We use your PII to provide you with a personalized membership card and services. M·A·C PRO may also use your PII to respond to your requests and inquiries and provide you with information related to your membership, e.g., to confirm receipt of your application form, to provide you with information about your membership such as benefits and expiration, to address an issue with your membership or to respond to product questions or concerns expressed on Pro Talk. These types of communications are necessary to serve you, respond to your concerns and to provide the high level of customer services that M·A·C PRO offers to its members.
Please note that each M·A·C PRO member must consent to receive M·A·C PRO communications by postal mail. You may choose not to receive M·A·C PRO communications via email but this may limit our ability to provide you with the full range of M·A·C PRO services and events from which you might otherwise benefit.
B. Research
M·A·C PRO continually works to improve and enhance the products and services that we provide to our members. We may use the information you provide in aggregate form for internal business purposes, such as generating statistics and developing marketing plans.
C. Marketing
Unless you opt out as described in Section X of this Privacy Policy (NA), in addition to receiving M·A·C PRO communications by postal mail, you will receive M·A·C PRO communications by means other than postal mail, e.g., fax, phone and email. Unless you opt out as described in Section XI of this Privacy Policy (NA), you may, on occasion, receive postal mail communications from M·A·C about promotions, events, products and services. On occasion, M·A·C PRO may sponsor or co-sponsor special events, including promotions, sweepstakes, questionnaires or other events. The rules or terms and conditions for those events may indicate the use by M·A·C PRO of the PII provided for the special event and, where the special event is co-sponsored, the sharingof your PII with our co-sponsor. If you choose to participate in these events, you will have the opportunity to opt-out of any use or sharing of your PII not directly related to the special event. M·A·C PRO is not responsible for and disclaims all liability for any third party use of the PII you choose to provide to third-parties.
D. Enhancing Your Online Experience
We may use pixel tags to determine what types of e-mail your browser supports. We may use the information collected through pixel tags, tracking links and similar technology in combination with your PII to enhance your experience on the M·A·C PRO Site.
IV. Under what other circumstances and to whom will Brand disclose my PII?
The limited sharing of your PII with special event co-sponsors is described above. Brand will not otherwise disclose your PII except in the limited circumstances listed below:
A. Fraud Protection
We may exchange information, including PII, with other companies and organizations for credit fraud protection and risk reduction. We will also track M·A·C PRO member purchases from various channels, in accordance with our Terms and Conditions, in order to detect and prevent any violation of our policies and procedures.
B. Legally Authorized or Required Disclosure
M·A·C PRO reserves the right to disclose PII if a law, regulation, search warrant, subpoena, court order, legal process or governmental request legally requires or authorizes us to do so.
C. Service Providers
We may retain other companies to provide services on our behalf. Such service providers include web hosting companies, customer support specialists, database administrators, technical support service providers, data analysis firms, email service providers and fulfillment companies (e.g., companies that process M·A·C PRO applications and provide you with your membership card). These service providers may be provided with PII needed to perform their services for the purposes listed in this Privacy Policy (NA), but may not use such PII for any other purpose. These service providers may be located in the country in which the data was provided or another country that may provide a lower level of protection to PII. However, we demand that all such service providers agree to procedures at least as restrictive as the procedures that we follow ourselves with respect to PII, including this Privacy Policy (NA).
D. Business Transfers
As we continue to develop our business, we might sell certain of our assets. In such transactions, customer information, including PII, may be transferred in order to continue providing you with membership services you have requested from M·A·C PRO. Should PII be transferred in such circumstances for different purposes, your consent or an opportunity to opt-out will be provided.
We take reasonable steps to protect all of the PII we hold from misuse, loss,unauthorized access and modification or disclosure in violation of this Privacy Policy (NA). This protection applies in relation to information stored in both electronic and hard copy form. For example, access to databases is restricted to authorized personnel.
E. Group Companies
The information you provide may be shared with companies and business entities which are owned or controlled by MAC Pro's parent company that distribute, market or support M·A·C products and services (the "M·A·C Companies") in order to provide you with products, information and services. M·A·C Companies may be located both inside and outside the United States, Canada and the European Union. How ever, M·A·C Companies will only collect and use PII in conformity with this Priv acy Policy (NA).
V. How long does M·A·C PRO retain my PII?
We do not retain your PII for any longer than is necessary to fulfill the purposes specified above. We will retain your basic PII, e.g., name, address, phone , professional status for so long as you are a M·A·C PRO Member and for five years thereafter. Once your application has been processed, all supporting verification documents that you provided are destroyed. If you elect to have your membership renewed automatically on the M·A·C PRO Site, we will retain your credit card information to provide this service to you.
VI. What non-PII does M·A·C PRO collect about you and how does it collect it?
We may collect, store or accumulate certain non-PII concerning your use of the M·A·C PRO Site, such as information regarding which of our pages are most popular.
In addition, we may use IP addresses to analyze trends, administer the M·A·C PRO Site, track traffic patterns, and gather demographic information for aggregate use, as well as for credit fraud protection and risk reduction. Except as otherwise disclosed in this Privacy Policy (NA), we will not use IP addresses in combination with your personally identifiable information without your prior consent.
We may share or transfer non-PII with or to our affiliates, licensees and partners.
VII. Changes to this Privacy Policy (NA)
This is our current Privacy Policy (NA). It outlines our PII management practices with respect to data collected in connection with the M·A·C PRO program in North America and replaces any other privacy policy published by us prior to the date below with respect to data collected. We may change this Privacy Policy (NA) from time to time. As noted above, this Privacy Policy (NA) was last updated and is effective as of November 8, 2005.

For example, your PII may have been destroyed or deleted after expiry of applicable retention periods, the requested information may contain PII of other persons or it may contain commercially sensitive or proprietary information. If we are unable to provide you access to your PII, we will explain why and document this for you.
You play an active role in assisting M·A·C PRO in maintaining the accuracy of your PII. Your prompt notification to us of any changes to your PII will assist us ensuring that you fully benefit from the range of M·A·C PRO membership services we offer.
X. How can I opt out of M·A·C PRO communications other than postal mail?
You may opt-out of receiving M·A·C PRO communications that are not made via postal mail and that are not necessary to provide customer service as described in Section III(A) by emailing M·A·C PRO Membership at:

* Please note that when you opt-out, it is possible that you may receive materials for which you have opted out if such materials were scheduled for distribution prior to our receipt of your opt out.
